Right of withdrawal

The juices are fresh food products that are subject to a particularly high risk of rapid spoilage. For these goods, the consumer's statutory right of withdrawal is excluded under § 312g para. 2 sentence 1 no. 2 BGB (German Civil Code).

Right of withdrawal

The products are chilled fresh juices with a very limited shelf life. They spoil very quickly, especially if not stored properly. Because they are perishable, they can no longer be sold once returned. The juices are therefore products within the meaning of § 312g II no. 2 BGB, i.e. goods that can spoil quickly or whose expiry date would be quickly exceeded. For this reason, there is no right of withdrawal for our drinks. The following applies to all other goods:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us (Frank Juice GmbH, Grüntal 34, 81925 München, Fax: + 49 (0)89 21 58 05 81, Email: info@thefrankjuice.com ) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You may use the enclosed model withdrawal form for this purpose, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired. Consequences of withdrawal: If you withdraw from this contract, we must reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is earlier. You must send back or hand over the goods to us (Frank Juice GmbH, Grüntal 34, 81925 München) without undue delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.
